“I cheated the bribers” is not a sound defense to a bribery charge

The walls are closing in around the Bidens. Sworn testimony and bank records show that they accepted at least $20 million from foreign entities during the time Joe was Vice President. These foreign entities are notoriously corrupt ones such as China, Russia, Romania and Ukraine.

Joe’s son was the ringleader, but it was Joe that he was selling. Joe was the “brand” according to sworn testimony. Who else could have been? There’s no conceivable reason for these foreigners to send millions to the Biden family other than to influence the “brand.”

Recall that Joe assured the American people in the 2020 campaign that he had never talked to his son about the son’s so-called business. In view of a written record showing that assurance was false, his new line doesn’t dispute that he talked with the son about his business, but, he says, he was never in business with the son.

But even the new line is already being undermined by clear evidence that Joe frequently talked with the foreigners who were sending millions to the son. About that, Joe and the Democrats say that the talks were innocent chats about such things as the weather. The fact that the foreigners sent millions days later was apparently coincidental.

For those of us who were not born yesterday or born Democrats, an alternative explanation has also been constructed. The foreign millions did not buy influence, according to the alternative explanation, but only the illusion of influence.

In other words, the son solicited money from the foreigners, and got the money, in exchange for express or implied promises that it bought them influence with Joe, but Joe was never actually influenced.

In short, Joe defrauded the bribers out of their millions. Hahahahaha!

Here’s the rub. It’s still bribery. If a public official expressly or impliedly promises something of value in an official capacity in exchange for money (or directs the money to go instead to a family member, such as a drug-addled, perverted, reckless deadbeat dad of a son) then it’s bribery.

A page on a website run by the Department of Justice (which is, in turn, run by Joe’s Attorney General) states:

A bribery conviction is not contingent on showing that the public official fulfilled a promise, because the essence of the crime is accepting the bribe. 

Under established case law, it doesn’t matter if the public official fails to actually deliver on his side of the bribe. It’s still bribery. In fact, it’s still bribery even if the public official lacks the authority or power to deliver on his side of the bargain.

The Bidens are in big trouble.

Thank the Republican House of Representatives for their investigation, but don’t thank the American justice system. The Attorney General should have appointed a special prosecutor long ago. He didn’t. In covering for his boss, he’s as corrupt as the boss. Er, I mean the Big Guy.

  1. Hunter Biden received millions as an unregistered foreign agent, violating FARA.. The DOJ’s sweetheart deal was aimed to protect Hunter from future FARA prosecution..

    Paul Manafort was prosecuted .. for failing to register as a foreign agent..

  2. Good morning Glenn! This is why the Biden Administration kept the Trump-appointed person investigated Hunter Biden in place. So he can complete his investigation.

    In my opinion, you owe it to your loyal readers/subscribers to let us ALL know your true feelings about Donald Trump. There is this big elephant in the room and I continue to hope with each article of yours that I read, that you will spend an article or two…or three on our 45th President. Please don’t remain silent like most of the politicians who are afraid of him! Thank you for reading, Glenn.

    • Ah yes, the “what about Trump” defense to the charge that the Bidens have taken millions in foreign bribes. That “defense” implicitely acknowledges the guilt of the Bidens, and seeks to change the subject.

      OK, I’ll bite. Now that we’ve agreed that the Bidens are on the take, I’ll allow you to change the subject to Trump.

      I’ve written many articles about Trump. My feelings in a nutshell are: He’s not a nice person; however, he does love his country; I agree with most of his political poistions; he’s been persecuted by both the press and the establishment (Russian collusion, anyone?); he’s made things worse for himself with selfish antics; I voted for him twice; I wish he were not running in 2024; but if he is, and is the nominee, I’ll vote for him again over anything I see in the Democratic field.

      Meanwhile, Joe and Hunter belong in jail, and I say that without any hyperbola.

      • For my part, Glenn, what I’d like to see is your legal eye turned upon one or all of the indictments leveled against him, particularly the one(s) concerning January 6th leveled by Jack Smith. What are Trump’s lawyers’ best strategies, options, motions, etc.? Is a preemptive appeal to the Supremes a possibility, or even a smart thing to do? Etc.

  4. It’s laughable that Rep Goldsmith continues to claim there is nothing to see here. They were talking about weather. You know like Loretta Lynch and Hillary were talking about grandkids during the famous tarmac meeting. Then there was the “illusion” of influence theory. As if Russian oligarchs and corrupt Ukrainians would pay millions, get no results, and Hunter would not be mysteriously pushed off a building.

  5. Well yes, there’s this but how about during the Obama Years? I mean exactly what did he do to get so wealthy as well? All those Green Energy outfits that went belly-up but the owners still had direct deposit. The Graft in DC has been allowed to grow exponentially and perjury is no longer a crime in that area. Rham Emanuel and his brother are guilty as sin for the same things Manafort got sent to prison for. Rule of Law needs a “Surge.”

  6. Clearly a different standard than existed 3 years ago. Did anyone in the Trump family ever receive 8-figure payments from shadowy figures in China, Russia, Romania and Ukraine? And had they, would any Democrat accept they “Well, they weren’t influenced by any of that” excuse?

    I doubt it. After all, the Clintons were just as egregious with their foundation and nothing of consequence ever happened to them. The deep state will continue to run interference for Democrats. Even if Republicans take everything in ’24, they won’t have the balls to follow up on any of this.

  8. I think the biggest concern and reality is that now the USDOJ has dragged its feet for so long that these slow walking investigations are purposefully done to run out the clocks on these various influence peddling, tax evasion, and gun and drug crimes by the Biden Crime Inc. family.

    The simple fact is that the statute of limitations are expiring or have expired on the most serious allegations.

    I’ve said it before, and I am not happy saying it, but I’ll say it again … no Biden will be imprisoned whatsoever, nor is it likely that any Biden will even be convicted. If there even is a conviction, then there will be a pardon.

    I clearly see a dual system of Justice that is now in place in America … two tracks; one designed to get powerful Democrats off scot free like Hillary Clinton, the corrupt and politicized FBI hierarchy and other Deep State actors (ex-CIA Brennan and ex-Intel Chief Spook Clapper come to mind) and the Biden Crime Inc. family. The other track; the Spanish Inquisition treatment of conservatives, MAGA supporters, and anyone with the last name of Trump.

    The USDOJ and FBI seem to act as a public defender like the ACLU for Democrats and Progressives, while at the same time functioning as Grand Inquisitor Torquemada when it comes to DJT, conservatives and MAGA supporters.

    I hope I am wrong. But our justice system just seems so out of whack that I really have no faith in it at this time.

    But maybe there is some deeper legal insight on here that can address the statute of limitations angle. I do think that as these past alleged crimes expire, that Congress could in theory get some of these people to testify, then if they lie to Congress about these expired crimes, then they could be prosecuted for perjury, much like what was done to outed communist Alger Hiss.
